Our client specializing in the supply of chemical products from Finland, in January 2022 filed a request for participation in the tender in the framework of the Procurement Law No. FZ-223. According to the results of the tender in February 2022, the client was recognized as the winner, but in early March the Finnish manufacturer of chemicals informed that all deliveries to Russia were suspended for an indefinite period due to a special military operation in Ukraine. Our client informed the customer about the inability to fulfill the contract and that they would not be able to proceed with the tender results. The customer filed a complaint with the Federal Antimonopoly Service and demanded that information about our client be added to the registry of unscrupulous suppliers. During the review of the case in the FAS Administration for the Republic of Karelia, we presented evidence that the impossibility of concluding the contract based on the results of the tender is related to the refusal of contractual obligations by the Western counterparty, and that our client has no other ways to ensure the supply of chemicals provided for by the terms of the tender. These arguments were taken into account by the FAS, which on June 8, 2022, made a decision in case 011/10/5-368/2022 to refuse to include information in the register of unscrupulous suppliers.
